If the Remuneration (excluding conditional payments) of an Individual in a Transaction is above USD 200,000 (or equivalent), there will be a service fee cap for the annual excess amount. If the Soccer Agent is representing either an Individual or an Engaging Entity, the service fee cap will be 3%. However, if the Soccer Agent is representing both the Engaging Entity and the Individual, the service fee cap will be 6% as dual representation is permitted. The calculation for determining the relevant service fee cap of the Individual's Remuneration will not include any conditional payments. When calculating the transfer compensation, any compensation paid for breach of contract (in accordance with article 17 or Annex 2 of the Regulations on the Status and Transfer of Players) and/or any sell-on fee must not be included. However, other conditional payments that are not sell-on fees, such as loyalty or performance bonuses, may be included in the calculation of the transfer compensation.
