During a Transaction, while acting on be half of a player and an engaging club, can a FIFA Soccer Agent be granted a mandate solely by the engaging club to transfer the player in the future?

The general rule is that a Soccer Agent can only provide services to one party in a transaction, with the exception of dual representation where a Soccer Agent can represent both an Individual and Engaging Entity in the same transaction. However, in certain circumstances, such as when a Soccer Agent represents an Individual to be transferred to an engaging club and then enters into an agreement with that same club for a potential onwards transfer of the same Individual, there is a high risk of a conflict of interest. This may result in an investigation and potential sanctions under article 16 paragraph 2 (c) or article 18 paragraph 2 (d) of the FIFA Football Agent Regulations (FFAR). The situation may create a conflict of interest as the Soccer Agent may prioritize obtaining a good deal from the engaging club for the onwards service fee, rather than focusing solely on securing the best deal for the player during the earlier transaction.
